What your car's event data recorder actually stores after a crash
Almost every passenger vehicle built after 2014 contains an event data recorder, or EDR. Most owners never think about it until the day it matters: a disputed liability claim, a contested fault determination, or a criminal case where the driver's account and the physics do not agree. The EDR is the closest thing a road accident has to a flight recorder, and in our work on vehicle-related disputes it is one of the most decisive, and most misunderstood, pieces of evidence available.
## What the EDR records
A modern EDR captures a rolling window of data from the vehicle's controller area network. When a crash event trips the trigger, typically a sudden deceleration or airbag deployment signal, the device writes the preceding seconds to permanent memory. On most GM, Ford, Toyota and VW group vehicles that window is five seconds before impact and a fraction of a second after.
The specific channels vary by manufacturer, but the core set is consistent across nearly all of them:
Vehicle speed, sampled five times per second on most units. Engine throttle position and percentage. Brake pedal status, on or off, and in newer vehicles brake pressure. Steering angle in the seconds before the event. Seatbelt status for the driver and front passenger. Airbag deployment timing and crash pulse severity. Whether an autonomous emergency braking or stability control system intervened.
What it does not record is just as important. The EDR does not store location, so it cannot tell you where the crash happened. It does not record video, audio, or driver identity. And it does not keep a history of previous trips. One event, or in some units up to three if memory has not been overwritten, and nothing else.
## Who can legally read it
This is where disputes usually go wrong. The data is not freely available to anyone who asks. In the EU, the right to access EDR data sits with the vehicle owner, and in the context of a civil claim the vehicle is often held by an insurer or a repair facility, which complicates things. In the United States, most states require either the owner's consent or a court order to image an EDR.
Reading the data requires the manufacturer's crash-data retrieval toolkit, the Bosch CDR system being the most common, plus the correct cable and sometimes a direct connection to the airbag control module if the connector was destroyed in the impact. A readout on a badly damaged module can take hours, and each successful imaging produces a report with the tool's calibration checksums, which matters for admissibility.
If you are a party to a dispute, the practical sequence is: preserve the vehicle, request or obtain authorization for the imaging, and get it done by someone who can testify to the chain of custody from the module to the report. An EDR printout that appears without provenance is far easier to exclude than one that arrives with a documented imaging log.
## Where the data helps, and where it does not
The EDR is at its best on narrow factual questions. Was the driver braking? What speed was the vehicle doing in the final five seconds? Did the seatbelt latch? These are binary readings that are hard to argue with when the imaging is clean.
It is weaker on the questions people most want answered. Speed is recorded at the wheel and drivetrain level, not as a GPS-verified ground speed, so wheel slip, tyre size changes or a vehicle sliding sideways can distort it. The five-second window rarely captures the cause of a crash, only its final moments. If the dispute is about who entered an intersection first, the EDR will not settle it. That is a job for dashcam footage or timestamped telematics, which record continuously rather than on a trigger.
In our experience the two sources work best together. The telematics and dashcam record establishes the journey context and the moments the EDR missed, while the EDR gives calibrated, high-resolution readings for the final seconds. ## A realistic expectation
An EDR report will not hand you a verdict. What it does is collapse the space of argument. When one side claims hard braking and the pedal channel shows zero brake application for the final five seconds, the case tends to resolve quickly. When both sides' accounts are consistent with the data, you know the dispute will turn on other evidence and you can stop paying for a fight the black box cannot settle.
If you are facing a disputed vehicle incident, preserve the vehicle before anything else is done to it. Once a damaged car is repaired or scrapped, the module and its one recorded event are gone for good.
